Terms of service

Version 1.0. These terms govern use of the Kestrel platform operated by [OPERATOR LEGAL NAME — set in admin settings] (“the operator”, “we”), and form a binding agreement between the operator and you.

Read the risk disclosure before depositing. It states, with measured figures, what a normal losing period looks like.

1. Regulatory status

The operator provides these services under [LICENCE NUMBER AND REGULATOR — set in admin settings]. Services are offered only where the operator is permitted to offer them, and are not available to residents of jurisdictions where they would be unlawful or where the operator is not authorised.

You are responsible for confirming that your use of the platform is lawful where you live, and for any tax arising from it.

2. The two services

2.1 Managed account

You open an account with a third-party broker in your own name. You provide credentials that permit the placing and management of trades. Under this service:

  • Your funds remain with your broker, held in your name, at all times.
  • The operator never takes custody of your funds.
  • The connection cannot initiate a withdrawal or transfer from the account.
  • You may revoke access, pause trading, or close positions yourself at any time.
  • The service is charged as a flat subscription, payable whether the period is profitable or not.

2.2 Pooled account

Client capital is combined into a single trading account operated by the operator, so that a small balance receives the same execution as a large one. Under this service:

  • Your interest is recorded as units. A deposit buys units at the current net asset value per unit; a withdrawal sells them at the value then current.
  • Trading results change the value per unit and never the number of units held. Your share therefore moves in exact proportion to what you contributed, regardless of when others deposit or withdraw.
  • Funds are held in the operator’s trading account, not in your name.
  • Withdrawals are processed manually, as set out in section 5.

3. Fees

The high-water mark. The performance fee is charged only on gains above the highest value your holding has previously reached. If the account falls and then recovers, you are not charged again for regaining ground you had already reached. The fee is calculated per investor, not across the pool.

All performance figures published on this site are shown after the 5% performance fee has been deducted.

4. Deposits

  • The minimum deposit to the pooled account is $0.50.
  • Deposits are made in cryptocurrency to the address shown in your account area. You must submit the transaction identifier so the payment can be matched to you.
  • Units are issued only after the operator has confirmed receipt. Until confirmation, a deposit is recorded as pending and is not earning or losing.
  • Sending from an exchange account not in your own name may delay or prevent confirmation.

5. Withdrawals

  • The minimum withdrawal is $10. This is an operational threshold: each payout is reviewed and processed by a person, and below that figure the handling cost exceeds the sum being sent. Your balance remains yours and may be withdrawn in full once it exceeds that amount.
  • Requests are reviewed manually against your deposit history and recorded transaction identifiers before payment is released.
  • Units are sold at the value current when the request is processed, which may differ from the value shown when it was submitted.
  • The operator may decline a request where identity cannot be verified, where the request appears fraudulent, or where release would breach applicable law — and will state the reason.

6. Identity verification

Account creation, deposits and withdrawals are subject to identity verification. The operator may request additional documentation and may suspend activity until it is provided. Verification data is handled as described in the privacy policy.

7. Trading risk

Trading leveraged instruments carries a high risk of loss. You may lose some or all of the amount committed. Published performance is derived from historical simulation and is not a guarantee. The measured figures and their limitations are set out in the risk disclosure, which forms part of these terms.

8. Your obligations

  • Provide accurate information and keep it current.
  • Use funds that are lawfully yours and that you can afford to lose.
  • Keep your credentials secure; you are responsible for activity under your account.
  • Not attempt to interfere with, reverse engineer or overload the platform.
  • Hold one account only, unless the operator agrees otherwise in writing.

9. Suspension and termination

You may close your account at any time; on the managed service by revoking access, and on the pooled service by withdrawing your balance subject to the minimum in section 5. The operator may suspend or terminate an account for breach of these terms, suspected fraud, or where required by law, and will return any remaining balance due through the normal withdrawal process.

The operator may discontinue either service with reasonable notice, in which case pooled positions are closed and balances returned.

10. Liability

The operator is not liable for trading losses arising from ordinary market movement, for the acts or insolvency of a third-party broker or payment network, or for loss caused by inaccurate information you supply. Nothing in these terms excludes liability that cannot lawfully be excluded, including liability for fraud.

11. Changes to these terms

Material changes will be notified in advance and the version number above will change. Continued use after a change takes effect constitutes acceptance. The version you accepted is recorded against your account.

12. Governing law and disputes

These terms are governed by the law of [GOVERNING JURISDICTION — set in admin settings]. Disputes should first be raised with the operator at [CONTACT EMAIL — set in admin settings], which will respond substantively. Where a dispute cannot be resolved directly, it is subject to the courts or dispute-resolution body of that jurisdiction.
